GENERAL TERMS AND CONDITIONS FOR PARTICIPATION IN THE BIG BANG KI FESTIVAL

§ 1 Area of usage

(1) These General Terms and Conditions regulate the contractual relationship between the participant and DUP Media GmbH, represented by the managing directors Ayse Mese and Heiko Hager, Schanzenstraße 70, 20357 Hamburg (hereinafter: DUP) as the organizer for participation in all components of the BIG BANG KI FESTIVAL .

(2) The General Terms and Conditions apply in their latest version. An adjustment of the general terms and conditions by DUP is possible at any time. Contractual partners affected by this must be informed. This also includes an extraordinary right of termination with a claim to reimbursement. If the participant does not object to the adjustment to the general terms and conditions within 14 days of becoming aware of it, they are deemed to have been accepted.

§ 2 Ticket purchases & -payment

(1) Tickets can – if available – be ordered online using the registration tool. There is no right to participate in the BIG BANG KI FESTIVAL.

(2) The ticket price stated is due immediately and the payment method provided by the visitor will be charged immediately after the ordering process. The final contract is in German. The general terms and conditions can be accessed again by the visitor at any time at https://bigbangfestival.de/agb/.

(3) The ticket price includes participation in the BIG BANG FESTIVAL. The price does not include, for example, travel, accommodation and subsistence costs for participants.

(4) See Tickets GmbH, as the responsible service provider for ticket processing, will send the participant an invoice for the remuneration with or after confirmation of registration.

§ 3 Masterclass-Applications

Our events are award, networking and information events. Lectures and master classes are also offered for participation, which are conducted by our partners. These partners are responsible under press law for the respective content.

Part of our service for participants is to inform them fully about the content of all events, regardless of whether the participant was able to attend a specific lecture or master class. For this purpose, we share the necessary contact details of the participants with our partners.

Participants will be informed immediately before the event about the content on offer and the partners involved. Event participants have the opportunity to inform the organizer of their preferences for participation in master classes.

There is no entitlement to participate in a specific master class. The organizer reserves the right to assign participants to another master class due to capacity reasons. The same applies if there is a short-term change to the program.

§ 4 Withdrawal & replacement participants

(1) The participant may nominate a substitute participant at any time before the start of the event instead of withdrawing. The declaration of withdrawal must be made in writing (address: DUP Media GmbH, Schanzenstraße 70, 20357 Hamburg) or by e-mail (events@jdb.de) to DUP.

§ 5 Right of withdrawal

No right of withdrawal for ticket purchases

When purchasing tickets for the Big Bang KI Festival, there is no statutory right of withdrawal according to §§ 355, 312g BGB.
According to § 312g para. 2 no. 9 BGB, the right of withdrawal is excluded for contracts for services in connection with leisure activities, such as cultural or educational events, if a specific date or period is specified for the provision of the service.
As participation in the Big Bang KI Festival is tied to a specific event date, there is no right to cancel or return tickets, even if the contract was concluded online.

Note:

This applies regardless of whether the purchaser is acting as a consumer or entrepreneur. Any voluntary goodwill arrangements (e.g. ticket transfer to another person) are at the discretion of the organizer.

§ 6 Changes to the event

(1) DUP is entitled to relocate the BIG BANG FESTIVAL in terms of location and/or time, to use other speakers instead of those announced or to change the program.

(2) If the event is completely or partially relocated or shortened, the contract is deemed to have been concluded for the changed period of time - unless the participant objects within two weeks of notification. The participant must be informed of this legal consequence in a notification. There will be no reduction in the agreed price.

(3) If there is an important reason - in particular if speakers are canceled or the number of participants is too low - DUP can cancel the event and terminate the contract extraordinarily. In this case, the parties' mutual performance obligations no longer apply; the participant receives back any compensation already paid. A claim for reimbursement of travel and/or accommodation costs as well as loss of work is excluded - unless such costs arise due to intentional or grossly negligent behavior on the part of DUP. Any further claims by the participant are excluded.

(4) DUP will inform the registered participants immediately of any changes to the time or location of the event and of any significant changes in the process as well as of any cancellation of the event in accordance with Section 6 Paragraph 1.

(5) Due to legal requirements or economic constraints, it may be necessary to downsize the event and limit participants. In this case, DUP will offer affected participants replacement services. If this is not possible or if these are rejected by the participant, the contract will be terminated and the associated refund will be given.

(6) If the event does not take place or is postponed due to circumstances for which the organizer is not responsible, such as force majeure and equivalent events, such as national mourning, weather influences, strikes or war, the organizer is not responsible for this responsible for any resulting loss or damage. In this case, the ticket will not be refunded.

§ 7 Entry to the event

(1) The visitor must present a valid ticket at the admission control without being asked. Since the tickets are personal, he may also be asked to identify himself with a valid official identification document.

(2) In order to ensure a safe and pleasant event for all participants, DUP reserves the right to refuse entry to visitors if they appear aggressive or abusive or are under the influence of intoxicants. Weapons or dangerous objects may not be brought onto the premises or into the event rooms.

§8. General limitation of liability of the organizer

(1) DUP is fully liable in accordance with the legal provisions a) for injuries to life, body and health that are based on a negligent or intentional breach of duty by DUP, its legal representatives or vicarious agents, b) for damages arising from the Product Liability Act and c) for damages , which are based on intent or gross negligence or in the case of a guarantee.

(2) DUP is only liable for minor negligence if an obligation is breached, compliance with which is of particular importance for achieving the purpose of the contract (“cardinal obligation”). These are obligations whose fulfillment enables the proper execution of the contract and on whose compliance the other contracting party regularly trusts and may rely. This liability is limited to contract-typical and foreseeable damage.

(3) Any further liability on the part of DUP is excluded; This also applies to tortious claims or claims for reimbursement of wasted expenses instead of performance. To the extent that DUP's liability is excluded or limited, this also applies to the personal liability of its legal representatives, employees or vicarious agents.

(4) The limitation period for the participant's claims is one year - unless they are based on intentional actions by DUP's legal representatives, their vicarious agents or their employees. The same applies to direct claims against the aforementioned persons.

§ 9 Special limitation of liability for the cloakroom

If the organizer offers to store items (e.g. coats, jackets, suitcases or bags) for the visitor free of charge (“cloakroom”), the following conditions apply:

The visitor is not allowed to leave any valuables (e.g. laptops, smartphones, jewelry), data carriers with confidential and/or business information, means of payment/cards or travel tickets at the cloakroom.

The organizer is only liable for property damage and financial loss due to damage or loss of items in the event of intentional or grossly negligent action by one of its organs and/or vicarious agents and/or vicarious agents.

Liability is limited to a maximum of 500 Euros per visitor.

§ 10 Data security

DUP uses the personal data collected during registration for the purposes of executing the contract and - if you have given your separate consent - for marketing and advertising purposes. A transmission to third parties (e.g. speakers, partners, sponsors) may be necessary for this purpose.

In particular in connection with registration and billing of participation fees, the necessary personal data will be transmitted to the service provider Eventix B.V., Van Eeghenstraat 96, 1071GL Amsterdam and used accordingly.

§ 11 Image-, Video- and Audio Recordings

DUP is entitled to make or have made commercial image, video and sound recordings of the BIG BANG FESTIVAL and use them for marketing purposes. By attending the event, you agree to the later use of the recordings.

§ 12 House Rules

The BIG BANG FESTIVAL is a closed event, DUP has exclusive house rules, legal remedies are excluded. The participant accepts instructions from the organizer and his assistants.

The respective house rules of the event location must be observed while on the premises and in the event rooms. In the event of violations of the house rules or unauthorized ambush/guerrilla marketing measures, the visitor may be excluded from further participation in the event and asked to leave the event rooms. Further claims of the organizer against the visitor remain unaffected.

§ 13 Final Provisions

(1) Subsidiary agreements must be in writing to be effective.

(2) The exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Hamburg, provided the visitor is a merchant. The law of the Federal Republic of Germany applies with the exception of the UN Convention on Contracts for the International Sale of Goods. Consumers with a habitual residence outside the Federal Republic of Germany can also rely on the law of the country in which they have their place of residence.
